JCVGantt Pro 3 Evaluation ContestRules and Regulations1. HOW TO PARTICIPATE 1.1 Time Period and Requirements: Monthly draw on the last day of each month. Starting at 12:00 a.m., Eastern Time, Oct 3, 2006 to 11:59 p.m., subject to the Rules and Regulations, users who download JCVGantt Pro 3 from Trial Downloads will be automatically entered in a database for a computerized raffle to win a GUERIN G-1 1GB Dictation/MP3 watch with Wristnotes Software (see www.wristnotes.com for details on the prize). 1.2 Contest Entry and Entry Limits: Upon completion of the download, eligible respondents are automatically entered in the Contest for one (1) chance to win the prize (See Rule 2). For purposes of any and all of the Contest draws, each person ONE (1) download per calendar month (should this contest be renewed). Respondents leaving an e-mail address and telephone contact number will be considered, for purposes of the Contest draw, to belong to the same person and therefore are subject to the above restriction. Any excess download entries will be deleted for purposes of the draw. No purchase is necessary (See Rule 3.8). 1.3 Awarding of Prize: Subject to the Rules and Regulations of the Contest, respondents completing the download are required to enter a correct e-mail address, telephone number, company name and personal name for validation should they be selected for the chance to win a prize. All prizes will be awarded to the person whose contact information (name and/or telephone number and email address) has been registered on the potentially winning download transaction. 2. PRIZES 2.1 Prizes: There will be one prize available to be won in the Contest – G-1 Watch + Wristnotes Software for Windows XP and higher. The prize will be delivered to winner within 4 to 6 weeks of the prize draw. There will be no regional allocation of prizes. 2.2 Prize Draws: There will be a monthly (1) draw for the prizes, with one (1) prize awarded by a random draw for each month. The draw will be made by a random computer-generated selection on the last day of each month in St-Bruno, Quebec, from all eligible entries received during the month from 0:00 EST on the first day until 23:59 on the last day of the month. 2.3 Each selected entrant will be contacted by phone or email at least three (3) times within the fourteen (14) days after the specific Draw. If the entrant cannot be contacted in that time, another selected entrant will be chosen. Where a selected entrant cannot be contacted because of incomplete or incorrect information, I and A Research will use reasonable efforts to contact the selected entrant. If I and A Research is unable to contact the selected entrant within fourteen (14) days after the specific Draw, another entrant will be randomly selected and the initial selected entrant will have no further recourse towards I and A Research or anyone involved in the Contest. In order to win, the selected entrant must first correctly answer a time-limited, skill-testing question involving creating a task in JCVGantt Pro to be administered by email (or by telephone), and he or she will be required to sign a standard Declaration and Release form confirming compliance with the Contest Rules and Regulations, the Eligibility Requirements, if applicable, acceptance of a prize as awarded and releasing the Contest Sponsors from all liability. Subject to Rule 2.1, no substitution for, or transfer of a prize, will be allowed. Each selected entrant will have seven (7) days to return the Declaration and Release form upon receipt. 2.4 Odds: The odds of being randomly selected for a potentially winning purchase transaction depend on the total number of correctly completed downloads received by e-mail during each specific month. 3. GENERAL RULES 3.1 Database randomization uses standard computer randomization techniques to select a user. Illegitimate entries will automatically be culled prior to the randomized search for a winner. I and A Research will be the sole and final reference source in validating Prize user index. 3.2 The Contest is open to all visitors to www.iaresearch.com, customers of I and A Research, except employees of, a member of the immediate family of an employee of, or retiree of, or domiciled with an employee of I and A Research, or any of its subsidiary companies, retailers, franchisees, agents, associates, dealers, representatives, advertising and promotional agencies, or the Contest organizers. 3.3 I and A Research will be the sole and final reference source in validating Prize user index. 3.4 Contact information entered in the download submission form downloads is automatically added to I & A Research’s Customer Relation database, and you may received informative e-mails from time to time from the company. Should you ever wish to be removed from this list, send an e-mail with the title “REMOVE” to support@iaresearch.com 3.5 I and A Research and Contest organizers are not liable for faulty computer components, software, or links, the loss or nonexistence of communications capability, or faulty, incomplete, incomprehensible, or erased computer or network transmissions that render a Contest entrant ineligible for the Contest. I and A Research and Contest organizers are also not liable for any damage or loss that may be caused directly or indirectly, in whole or in part, by the downloading of any software or form or the transmission of any information with regard to entering the Contest. 3.6 I and A Research and/or the Contest organizers reserve the right to cancel, terminate, or suspend this Contest, at their sole discretion, in the event a computer virus or bug, unauthorized human intervention, or any other occurrence beyond their control corrupts or adversely affects the administration, security, or normal operation of the Contest, subject to the approval of the Regie des alcools, des courses et des jeux du Quebec for Quebec residents. 3.7 By entering, Contest entrants agree to abide by the Contest Rules and Regulations and the decisions of I and A Research and the ion Contest organizers, which are final. I and A Research reserves the right to change or alter any of the n Contest Rules and Regulations or to cancel the Contest at any time. Except as specifically provided in the n Contest Rules and Regulations, all Prizes must be accepted as awarded, and are not transferable or convertible to cash. By accepting a Prize, winners agree to the use of their name, address and/or photograph, without payment, in any subsequent publicity or advertising carried out by I and A Research and/or its advertising agents. 3.8 No purchase is necessary. To enter, download JCVGantt Pro 3 and evaluate it within three (3) days of receiving your download information receipt. 3.9 The Contest is subject to all Federal, Provincial and local laws, as well as the rules adopted in view of said laws. The personal information provided to enter the Contest will be used only to administer the Contest, and for no other reason. 3.10 For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. 3.11 Each winner agrees to release I and A Research and the Contest organizers from any and all liability regarding prizes. Winners agree to sign a liability waiver form to this effect. No substitutions or cash alternatives will be allowed, except as specifically provided in the Contest Rules and Regulations. To be eligible to win, a selected Contest entrant must reside in country with a seat in the United Nations at the time he or she becomes eligible to win, otherwise the prize will be put back in the prize pool. All expenses and costs, which are not specifically indicated above as being included will be the winner's responsibility.
